Warmur Academy Ltd Course Terms & Conditions

These Terms outline the terms and conditions under which Warmur Academy Ltd (“WA”, “we”, “us”) provide study materials, training events, and training services (“a Course”) to Customers and Delegates (as defined below). By making a booking onto a Course, the Customer and Delegate are deemed to accept these Terms and Conditions.

Definitions

In these Terms, the following definitions apply:

“Booking”: The booking made by either a Customer or a Delegate, whether online, by email, phone, or post, in respect of a Course.
“Contract”: The agreement between the Customer and/or Delegate and Warmur Academy for the Course incorporating these Terms, together with the Booking and Warmur Academy’s acceptance of it.
“Course Fees”: The fees payable for the Course.
“Customer”: The individual, company, or entity making the Booking and responsible for paying the Course Fees. The Customer may also be the Delegate.
“Delegate”: The individual(s) booked to attend the Course.

Application of these Terms

These Terms form part of the Contract between the Customer, the Delegate, and Warmur Academy. They supersede any previously issued terms and conditions.

Part A applies to the Customer

Part B applies to the Delegate

Part C applies to both the Customer and the Delegate.

Variations or amendments to these Terms are only valid if expressly agreed upon by Warmur Academy in writing.

PART A – Applicable to the Customer

Fees and Payment Terms

The Course Fees are specified at the time of Booking and must be paid in full to confirm the Delegate’s placement on the Course. Fees include VAT where applicable.
Discounted payment plans or early enrollment promotions may apply if specified.
Customers accessing Courses through government or other funding must provide all relevant information for funding paperwork. If funding is unavailable or incomplete, the Customer is liable for the Course Fees.
Warmur Academy reserves the right to suspend access to the Course if payment terms are not met.

Cancellation and Refund Policy

Cancellations must be submitted in writing to bookings@warmuracademy.co.uk.
Refunds will only be issued if the cancellation is received at least 14 days before the Course start date, subject to a 25% non-refundable administration fee.
Refunds are not available after the Course has commenced or once online content has been accessed.
Refund requests for extenuating circumstances (e.g., illness) will be considered on a case-by-case basis, provided documentation is submitted promptly.
Customers may transfer a Delegate’s Booking to a future Course with at least 30 days’ written notice. Only one transfer is allowed per Booking.
In the event Warmur Academy cancels a Course, Customers will be offered a full refund or the opportunity to transfer to another Course.

Delegate Information

Delegate names and contact details must be provided at the time of Booking.
The Customer is responsible for informing Warmur Academy of any special requirements to accommodate Delegate needs.

PART B – Applicable to the Delegate

Delegate Responsibilities

Delegates are expected to:

Treat Warmur Academy staff, instructors and fellow Delegates with respect.
Actively participate in all Course activities.
Notify instructors of any challenges affecting their progress.
Adhere to venue rules or guidelines for virtual sessions (e.g., camera on during delivery).

Failure to comply with behavioral expectations may result in removal from the Course without refund.

Attendance

Delegates must attend all scheduled sessions and complete all assignments and assessments to receive their certification.
Punctuality is required. Warmur Academy is not obligated to provide additional support for missed content due to tardiness or absence.
If a Delegate fails to attend without prior notice, rebooking will be required at the Customer’s expense.

PART C – Applicable to Both Customer and Delegate

Course Information and Materials

Joining instructions will be sent via email upon confirmation of Booking. Delegates are responsible for reviewing and adhering to these instructions.
All Course materials are the intellectual property of Warmur Academy and are provided for personal educational use only. Unauthorized reproduction, sharing, or distribution of materials is prohibited.
Delegates must have the necessary equipment and internet access to participate in online Courses. Warmur Academy will provide guidance on technical requirements prior to the Course start date.

Qualification

Upon successful completion of all Course components, Delegates will receive a Low-Temperature Hot Water (LTHW) Certification.
Certification is granted based on attendance, participation, and assessment completion.
Warmur Academy reserves the right to withhold certification if Delegates fail to meet the required standards.
Warmur Academy accepts no liability for any loss, financial or otherwise, arising from delays in the release of online modules that may affect the timing of LTHW certification. Customers and Delegates are advised to plan accordingly.

Disclaimers and Limitations of Liability

Warmur Academy’s total liability for any claims related to the Course is limited to the Course Fees paid.
Warmur Academy is not responsible for any technical issues encountered when accessing online modules, except where the fault lies with Warmur Academy’s platform.
Warmur Academy accepts no responsibility for loss or damage to personal property during face-to-face sessions.
Warmur Academy does not guarantee any specific outcomes, such as employment or business success, from completing the Course.

Amendments and Updates

Warmur Academy reserves the right to update Course content, schedules, and venues. Customers and Delegates will be notified of significant changes.
Warmur Academy reserves the right to change instructors or guest speakers without prior notice.

Force Majeure

Warmur Academy is not liable for delays or non-performance caused by events beyond reasonable control, including but not limited to natural disasters, strikes, pandemics, or government restrictions.
In such cases, Warmur Academy will make reasonable efforts to reschedule affected Courses or offer alternative solutions.

Data Protection

Personal information collected during Booking will be handled in accordance with Warmur Academy’s Privacy Policy. For details, visit [insert privacy policy link].
By enrolling in a Course, Delegates consent to the use of their data for training administration and certification purposes.

Governing Law

These Terms are governed by and construed in accordance with the laws of Scotland when the program is completed in Scotland.
Disputes arising under these Terms will be subject to the exclusive jurisdiction of the Scottish Courts where applicable.
