1. Introduction

The contract between client and tutor covers all tutoring activities and is provided by GLA to help all parties work together. Global Learners Academy (GLA) is only responsible for the actions of its tutors and takes no responsibility for the actions of the client.

2. Booking terms

On using the site to book a tutor, the client creates an agreement with Global Learners Academy (GLA) to provide a service (lesson) at the specified time and place.

2.a. Clients may register with GLA whilst making payment for any of our products and services online via our websites https://www.globallearners.academy/ and https://gla-tutors.square.site/

2.b. All products and services must be paid for in advance.

2.c. A service is booked when a time slot has been agreed, after payment, and added to the GLA calendar. The event will be turned green by GLA to show it has been paid for by the client. A notification of the booking is sent to the client by email from the GLA calendar for them to accept or decline. This is then a booking. A booking creates an agreement between GLA to provide a lesson at the time agreed unless it is cancelled in accordance with section 3.

2.d. Future unbooked time slots of tutors are always available for anyone to book. They cannot be reserved for a client until they have been paid for.

2.e. Where applicable, additional travel charges and expenses will be included in the price should the lesson be impractical remotely due to the specific needs of the client. With the exception of the standard package, the fee includes teacher lesson planning time and resources.

2.f. Any discounts or promotions offered by our marketing team will be provided as a voucher / gift code by GLA to be used at the online check out.

2.g. All online lessons are provided via Zoom and resources and reports are shared on the G-Suite for Education platform.

2.h. The client and tutor agree to use the GLA website to book all future lessons (see section 9).

2.i. Clients are advised that although their booking will be emailed to the tutor immediately, bookings at short notice or without prior messaging should be regarded as provisional until confirmed.

2.j. A booked lesson must be honoured by both parties and cannot be cancelled or changed unless it falls within the agreed cancellation procedure outlined in section 3.

2.1 Booking terms - Subscriptions

We provide subscriptions for those who are serious about their studies and want to follow a course without interruption. For this approach we reward clients with the offer of 10% discount.

2.1.a. Subscriptions can be purchased from our square marketplace website https://gla-tutors.square.site/ which is linked to our main website via the ‘book or subscribe’ tab.

2.1.b. A subscription auto-renews on the same date every month.

2.1.c. All hours subscribed to must be used up before the next payment due date.

2.1.d. It is not possible to ‘push back’ hours into the next monthly cycle. Any hours not used up will be lost.

2.1.e. This option is not suitable for people who choose to take regular breaks from their learning.

2.1.f. A subscription can be paused for the Christmas Holidays and the Summer Holidays or Family Holidays.

2.1.g. Pauses for subscriptions are limited to two per year.

2.2 Booking terms – Subscriptions for In-School Support

Where in-school provision is provided long term, the standard hourly rate does not apply. Instead, a discounted rate applies to ensure continuity though the year that covers the tutor for non-contact time in the Half term breaks and the Easter Holiday. This does not mean that the tutor will not be working for your child during those breaks.

2.2.a A fixed fee of £800 per month is payable without any pauses or breaks unless ended.

2.2.b. At least two weeks’ notice is required to end the agreement. The notice must be two weeks before the next payment date.

2.2.c. The arrangement must be set up on a monthly auto-renewal subscription and paid for in advance.

2.2.d. Before entering any school, the parents must have had a meeting with the school leaders and formally introduced the tutor to the school.

2.2.e. A tutor may not enter a school without having a DBS on the update service.

2.2.f. A subscription can be paused for the Christmas Holidays and the Summer Holidays only.

2.2.g. Pauses for subscriptions are limited to two per year.

2.2.h. Contact time takes place during school hours and in school only.

2.2.i. If there are no pauses in the subscription, then the client will be entitled to the following amount of home provision:

2.2.i.i Easter Holidays: 5 hours

2.1.i.ii Summer Holidays: 20 hours

2.2.j. GLA Tutors do not work through the Christmas Holidays.

2.2.k. Contact time with the child is 5 hours per school week to be split across the week in whichever way is most suitable for the child.

2.2.l. The fee includes non-contact time of up to 2 hours per week for planning, assessment, resourcing, meetings and reporting.

2.2.m Regular updates will be sent home by text each day or once a week (whichever is preferred).

2.2.n. A progress report against stated targets on performance in the previous term, with renewed targets suggested for the new term, will be sent home at the beginning of each half term.

2.2.o. Hours cannot be made up at any other time because the child did not attend school due to sickness, appointments or family holidays. The tutor will use that time to plan, prepare, assess or meet with any necessary interested person.

2.2.p. Should the above terms not be agreeable, or not met, then the subscription will be ended, and the contact time will be charged at the hourly rate of £60 per hour (£300 per week or £1,200 per month) and this will not include non-contact time for planning and assessment.

3. Cancellation

We understand life can get a little hectic at times and priorities may change. Whilst we aim to offer understanding and flexibility, we must protect our teachers from financial hardship and loss. We respectfully ask that you provide us with as much advance notice as possible when cancelling or rescheduling so that we can fill the slot that becomes vacant.

3.a. A client can cancel a booking at any time before the lesson starts by emailing or calling the tutor. Refunds cannot be given for cancellations.

3.b. For a session to be eligible for rescheduling, at least 48 hours’ notice is required.

3.c. When giving notice to reschedule, suggestions for a new time must be made.

3.d. The new time must be within 14 days of the original booking. Any time after that will be considered cancelled.

3.e. If the tutor cancels a lesson, they must offer the client the option to reschedule or provide a full refund.

3.f. The tutor will signify cancellations by turning the event on the calendar to the colour red. This means that the lesson did not take place and needs to be rescheduled. Details of cancellation must be written by the tutor into the calendar event, an update of which will be emailed to all parties.

3.g. Lessons and bookings cannot be rescheduled after they have started. These will be deemed cancelled and cannot be refunded.

3.h. Both the client and the tutor may reschedule one session each per month without any limitations.

3.i. Different cancellation rules apply for in-school provision.

3.1 Planned Holidays

Planned holidays must be communicated at the beginning of the course. These will be added into the schedule and missed lessons can be pushed back and tacked onto the end of the course. For subscriptions, see 2.1

4. Payment terms

Clients pay in advance for a number of hours. Both parties must keep a timesheet that records the number of hours completed. The hours must be reconciled between client and tutor before the next payment is made.

4.a. Clients will pay for our advertised products and services via GLA’s online sites only and sales receipts will be provided by email.

4.b. We accept all major credit and debit cards. For customers using Clearpay, please see their own terms and conditions relating to your payment instalments.

4.c. We do not invoice for our services. However, if you require an invoice then please request one from admin@globallearners.academy

4.d. To protect ourselves and the client, payment will be held in our account and will be sent to the tutor upon completion of the assignment.

4.e. Where an assignment is more than a month, the tutor will invoice GLA for the completed hours on the first day of the following month.

4.f. Payment for those hours will be made subject to inspection of completed time sheets and provided that no disputes between the client and tutor have been raised.

4.g. Each booking will be deemed to have taken place as agreed and satisfactorily if neither party, nor GLA, raises an issue within 48 hours of completion of the booking.

4.h. Tutors are normally paid BACS transfer.

4.i. We are not eligible to charge VAT on our services.

5. Client responsibilities

5.a. The Client is responsible for complying with the Terms of Usage, which they agree to on registration (payment for our services) and, in particular, must:

5.a.i. Be of legal age and be in a capacity to agree to these terms.

5.a.ii. Provide accurate, current and complete information about themselves.

5.a.iii. Maintain the security of their password and identification.

5.a.vi. Where applicable, the client needs to make sure the booking includes the correct address and that they have given sufficient detail for the tutor to prepare the lesson.

5.b. The client is responsible for making sure that they are at the address given or ready online at the lesson time; and have made suitable arrangements for a tutorial to take place.

5.c. If the lesson does not happen the client is responsible for informing GLA by email within 48 hours and raising an Issue. The Issue will be investigated, and the appropriate action will be taken.

5.d. Clients are responsible for satisfying themselves that a tutor is suitable to work with the student and must inform GLA immediately if they have concerns and we will work quickly to have these concerns resolved.

5.e. The client should not pay the tutor directly.

5.f. The client accepts that GLA is responsible for promoting the tutor’s advertised availability and providing communication & payment services for this contract.

5.g. The client should respect that the tutor is engaged to educate and assist; not to complete work on behalf of the pupil.

5.h. The client should make sure that tutors are not left alone with children and that they are always supervised by legal guardian.

5.i. If the lesson takes place at the student’s home, the client must ensure that an appropriate and formal workspace is provided. The client must also ensure consistency in that respect.

5.j. The client understands that we can only guarantee progress if our teachers are allowed to teach what they deem necessary after carrying out an initial assessment.

5.k. The client further understands that, if a tutor is asked to simply help children with school homework, then we cannot guarantee progress in any way. The tutor cannot be held accountable for the results achieved at school unless they have planned and taught their own lessons.

6. Tutor responsibilities

6.a. Whilst GLA will do everything we can to verify the validity of tutors’ statements of ability, the tutor remains responsible for their own statements on GLA regarding their subject knowledge.

6.b. The tutor is responsible for keeping their diary of availability up to date.

6.c. The tutor will ensure they are able to meet their bookings and arrive on time and prepared for the lessons.

6.d. The tutor accepts that they are responsible for their personal and professional behaviour on and off the GLA platforms; and acknowledge that they adhere to and are accountable for achieving the highest possible standards in work and conduct as set out by the Department for Education’s Teachers Standards document. A copy of this document is available on the website.

6.e. The tutor agrees to behave in accordance with generally applicable standards of professional behaviour and to comply with the Global Learners Tutor Contract and TTA Code of Practice and remain up to date with the latest statutory Safeguarding legislation.

6.f. The tutor is responsible for raising an Issue with GLA if the client is not at the lesson address or online at the lesson time; if the arrangements for the lesson are not suitable; or where there is any other behaviour that is inappropriate. Issues should be raised by email, so that it is recorded, as soon as practicable, and not later than 48 hours after the lesson time.

6.g. Agree to cover up to 5% of any agreed customer discount.

7. Global Learners Responsibilities

7.a. Provide the website and curriculum and quality of teaching which allows clients to find quality teachers with peace of mind for safety and legal and professional compliance.

7.b. Verify the identity of the tutors.

7.c. Conduct Disclosure and Barring Service (DBS) checks; and check references and professional certifications for all our listed tutors.

7.d. Arrange the collection of the funds when bookings are made using our online payment system.

7.e. Immediately communicate bookings and cancellations to the client and tutor via email.

7.f. Refund promptly when cancellations are made if appropriate.

7.g. Investigate any Issues and determine how the lesson fee should be allocated.

7.h. Pay the tutor’s invoice on the first day of each month, where no issue has been raised.

7.i. Indemnify the client against any losses incurred as a result of the malpractice of one of our tutors.

7.j. Indemnify the tutor against any loss of earnings that were the result of a material breach of these terms.

7.k. Agree to cover up to 10% of any agreed customer discount.

7.l. Pass any donation to the Jade & Paul Scholarship fund.

8. Child protection
Global Learners aims to create and maintain the safest possible environment for children and takes very seriously its responsibilities to safeguard and protect the interests of all young people who encounter our tutors.

8.a. Tutors are not to be left in sole care of a child under the age of 16.

8.b. Tutors are not to provide child minding services as part of their engagements under a GLA assignment.

8.c. Tutors agree to comply with the TTA Code of Practice and all relevant UK government legislation and guidance. Good practice is summarised in Government guidance on Safeguarding Children.

8.d. In the event of any concerns about potentially abusive behaviour towards a child, the client or tutor should record the details and report it to GLA immediately by emailing christopher@globallearners.academy and calling 07944956671. Our Safeguarding Lead at GLA is Christopher Daniels who will investigate the concerns and take appropriate action in line with Statutory Guidance.

8.e. If you are unhappy with the response you receive; or if you have any concerns about GLA, or our Safeguarding Lead, then you have the right to contact Lambeth Council (the local authority where GLA is situated) or the police to take further action.

9. Further purchases

9.a. The client and tutor confirm they will in no way try to undercut, transact independently or otherwise disintermediate GLA. If such behaviour is made obvious to GLA, it will be investigated and may result in the client and / or tutor being required to pay fees and expenses on all independent bookings with the possibility of further legal action being taken.

9.b. Further purchases between a client and a tutor, who were introduced through GLA, are subject to this contract and the client is jointly liable for any commissions due to GLA that have been avoided by not booking through our sites.

10. Data protection and the right to be forgotten
To comply with various legislative obligations, we collect information on clients and tutors that we are legally obliged to hold. Global Learners Academy Limited is committed to your safety and data protection. As a responsible company, we are registered with the Information Commissioner's Office (ICO) of the United Kingdom. Reference number ZB127018. The ICO is the UK's independent authority set up to uphold information rights in the public interest, promoting openness by public bodies and data privacy for individuals.

We promise to hold information only for the duration of your engagement with Global Learners Academy Limited to meet our obligations under the law to carry out proper due diligence; and to meet our safeguarding obligations.

We promise to keep your information safe and secure and will not distribute or use your information in any way that could affect your privacy and security.

Under Article 17 of the UK GDPR individuals have the right to have personal data erased. This is also known as the 'right to be forgotten'. The right only applies to data held at the time the request is received. It does not apply to data that may be created in the future. If you would like to have your data removed from our database, then please put your request in writing to admin@globallearners.academy

11. Definitions

11.a. GLA: the company Global Learners Academy Ltd and its websites.

11.b. Site: means the website on the domain www.globallearners.academy

11.c. User: any person who uses the site.

11.d. Client: a user who is purchasing educational services on the site or intending to do so.

11.e. Tutor: a user who is offering educational services on the site or applying to do so.

11.f. Booking: a lesson that has been booked in accordance with paragraph 2 above.

11.g. Cancellation: a booking that has been validly cancelled in accordance with paragraph 3 above.

11.h. Issue: a problem with the satisfactory provision of a lesson as agreed in a Booking raised by either Tutor or Client to Global Learners.

11.i. Jade & Paul Scholarship: the charity set up by Global Learners Academy

11.j. Registered User: a person who has completed registration; providing their name, email address, and agreeing to the terms of booking by paying for a service on our sites.

11.k. Terms of Usage: the terms on which users may use the site, agreed by the users on registration as amended from time to time.

11.l. TTA: The Tutors Association.
